Cari -- the accounting firm that prepared the 990 indicated that Schedule A is actually not required until the nonprofit has been in business for four years. Apparently it is a worksheet that is not relevant until four years of data exist. I've asked two accountants, both indicated that from their reading of the regulations filing Schedule A is optional prior to the first four years of existence. (Black Box Voting has been in existence 2 and a half years). I have no problem with filing it. It needs to be prepared by an accountant. I'll revisit that issue with the accounting firm this month and if the answer changes for any reason, I'll post that here. # # # # # ... uh-oh. I think you must find a new accounting firm right away. Are they licensed in your state? Attachment Schedule 'A' is a part of the filing, and the filing is incomplete without it. Submitting a filing without the attachment 'A' means penalty fees. The accounting firm would be liable for these fees for submitting it if they had signed it, but they apparently did not sign it, so looks like BBV is going to be liable. "Two accountants"? You should get them to show you the code where it says that. It doesn't. |

Please show the code that says the filing is incomplete without Schedule A prior to being in existence for four years. Either way, no penalty fees are involved, since it was filed early and will not be late until Feb. 16 anyway. The accountant who did the latest forms is a CPA. I'll feel more confident about your diagnosis if you, too, are a CPA, especially one with experience in nonprofits. Either way, of course I will check on this and obtain a written opinion, and either way, since it is not late, I doubt very much there will be penalty fees. If you are a CPA, we can continue this discussion online; if you are not, this conversation is speculative and must be continued in private e-mail. |
