Faxed July 11, 2008, mailed July 14, 2008: Oscar Villarreal - Webb County Elections administrator 1110 Washington St. Suite 103 Laredo, Texas 78040 July 11, 2008 RIGHT TO KNOW – PUBLIC RECORDS REQUEST #071108-Webb To whom it may concern, Pursuant to the state open records law, Tex. Gov't Code Ann. 552.001 to 552.353, I write to request a copy of the following records. Please respond to each item, separately, in writing. If you do not have anything responsive to the item, write that response down and submit that to us with your name and position. Item 1: A specimen copy of each form used in your 2008 elections, including but not limited to the items below. These forms can be blank or filled in; just one copy of each different form is requested. Please include: 1a. Telephone log form used for Election Day support 1b. Rover or technician log form used for Election Day support 1c. One copy of each form provided to poll workers for Election Day reporting 1d. One copy of each inventory management form used to track supplies, equipment, and voting system components 1e. One copy of tracking forms for voting system seals 1f. One copy of any chain of custody records used in connection with transport of any election supplies 1g. One copy of each form used in canvassing or certification processes. Item 2: A copy of the inventory assignment log showing assignment of voting machines to precincts. Also, a copy of the inventory assignment log showing assignment of PEBs, and compact flash cards to each iVotronic in Precinct 231. Item 3: A copy of the audit log for each iVotronic located in Precinct 231. Please provide this in electronic form. Please provide each item in electronic form if possible; Item 3 is an computerized report that must be provided in electronic form. If your agency does not maintain these public records, please let me know who does and include the proper custodian’s name and address. I agree to pay any reasonable copying and postage fees of not more than $50 for this information. If the cost would be greater than this amount, please notify me. Please provide a receipt indicating the charges for each document. I would request your response within ten (10) days. (Twenty (20) days if my request requires substantial programming or manipulation of data.) If you believe this information is not public, the law requires that you seek a formal decision from the Texas Attorney General and notify me not later than ten (10) calendar days from your receipt of this request. Tex. Gov't Code Ann. 552.301. Please be advised that violation of the open records law can result in a fine of up to $1,000, imprisonment of up to six months, or both. Litigation costs and reasonable attorney fees may also be assessed against you. If you choose to deny this request, please provide a written explanation for the denial including a reference to the specific statutory exemption(s) upon which you rely. Also, please provide all segregable portions of otherwise exempt material. Government is the servant of the people, and not the master of them. The people, in delegating authority, do not give their public servants the right to decide what is good for the people to know and what is not good for them to know. We insist on remaining informed so that we may retain control over the instruments of government we have created.
