UPDATE: I will be posting a follow up story shortly; I am pleased to see that Congressman Steve Cohen has referred this matter to the U.S. Department of Justice.

Elections administrator Richard Holden has responded to this article by pretending that this problem does not exist. To be absolutely clear: The crux of Mr. Holden's rebuttal is that documents he has released to the public do not match documents on the internal Shelby County system.

Now imagine this scenario: You do a public records request for a budget. You receive a budget which omits a sensitive set of expenditures. When you point out that the expenditures were somehow deleted, the official tells the media, "Well that is just the budget report given to the public; in my own budget, the expenditures show up in my own internal report."

Public records must provide a true and accurate copy of what is in the government's own records. Clearly, that is not the case in Shelby County.

ORIGINAL STORY:

Four hundred and eighty-eight voters, every one of them in the Tennessee district of US Rep Steve Cohen (D-09), all but four lifelong Democrats, and nearly all Black, had their voting history erased by Shelby County election workers, setting them up for purge from the voter list.

To alter voting histories for a selected set of voters, putting them at risk for strategically selected purge, is to demean them, to treat them as if they have less worth as human beings than they do. And to demean them is to wrong them. What Shelby County's election staff has done, in altering the records, is morally wrong.

DETAILS ON SHELBY COUNTY VOTER LIST ALTERATIONS

Shelby County voters owe a debt of gratitude to Darrick "D" Harris (no relation). This information has come to light because, when I spoke with Harris by telephone recently, he expressed concern to me about his discovery that his voting history had somehow evaporated.

An active Democratic voter and political consultant, Harris had copies of voter databases containing his own voter history. He knows he votes regularly, but as of Oct. 2011, the voter list reports that he has never voted -- not once!

WHY IS THIS IMPORTANT?

When voters fail to vote for two federal general elections, a purge process is initiated.

Your voter history should never vary. If it says you voted in the Nov. 2008 presidential election in 2010, in 2011 it should not report that you DIDN'T vote in 2008. The only way the database can alter your voting history is if someone changes the information in the database.

D. Harris did not just have his 2008 voting history erased. Every vote he had ever cast, going back to 2000, had been erased. I took the official Shelby County voter list, filedate 2010 (obtained by court order in a lawsuit) and compared it with the voter history list from 2011.

488 voters had their histories erased.

ALMOST ALL VOTERS WERE BLACK

Of these, according to the 2011 database, 430 are Black. It is against the law to alter voter records. It is a civil rights violation to select Black voter records for alteration.

WHY DILUTION OF RACIAL IDENTITY IS SIGNIFICANT

Last year, I reported that in Shelby County, they have been diluting the racial identifier so that thousands of Black voters are now reported as "other." Twenty-four of the voters with histories erased had also had their racial identifiers removed. In fact, 454 out of 488 on the erased list are Black, and only four are White, leaving all the others marked "other." Most likely, out of 488 erasures, 484 are Black.

ALMOST ALL ARE DEMOCRAT

Only five voters in the erased list show that they have ever voted Republican, but you'll notice that I listed that as just four in my opening paragraph. That's because Shelby County has also been altering party choice in its voter records. It is possible that Ruth Ann Phelps, one of the five so-called Republicans, never voted Republican at all.

Ruth Ann Phelps is reported as selecting a Republican ballot in the May 2010 primary, but her records show she is a lifelong Democrat. I found hundreds of lifelong Democrats whose voter history preference was altered in the May and August 2010 elections.

Phelps is an interesting case. She used to be one of the key employees at Shelby County Elections. She at one time had a password to the GEMS election management system, but the audit log for the GEMS database shows that Ruth Ann Phelps password was revoked in June 2010. Phelps at one time worked at the main elections operation center, where she had access to voter list maintenance systems, but in 2010 she was transferred to a downtown office. By 2011, her voter history had been erased. Right around this time, she retired.

THE SELECTIVE PREPARATION FOR PURGE TARGETS U.S. CONGRESSMAN STEVE COHEN

Not only are almost all the altered records Democrat, not only are they almost all Black, but every single one of them is in Congressional District 09.

POLITICAL TALK

I have heard that Cohen's seat is not considered at risk, though with redistricting and a well financed opponent, and paperless touchscreen voting machines, and selective removal of voters from his voting base, who knows?

I have also heard that the most astute political strategists focus on changing not just the weather (short term election results), but the climate (long term voting environment).

At any rate, it doesn't matter what Cohen's chances are. The rights that were violated are those of Shelby County VOTERS, who have a right to vote for the candidate of their choice, and who are entitled to accurate records.

And I have a question: How widespread is this problem? Are there other counties where voter histories are strategically eroding? I have spoken with both Democratic and Republican election integrity enthusiasts, and one of my frustrations is that the Democrats count on their VAN system and the Republicans count on their VOTER VAULT system to keep them up to date on voter list data. Neither of these systems is the real, working data. It should be possible to detect alterations like this in other counties, but since purges are performed using the actual county database, skip the VAN and VOTER VAULT: Examine the actual lists. As we see in Shelby County, there is no reason to believe that the raw data matches VAN or VOTER VAULT. The raw data is getting altered from time to time.

To detect this kind of alteration, a database created and saved in 2010 should be compared for changes with more recent iterations, but the actual county database should be used for the exam, rather than relying on proprietary party databases.

THEY SEND A LETTER BEFORE PURGING, DON'T THEY?

Altering the records is illegal, and a civil rights violation, regardless of whether voters can halt the purge process by responding to a letter. If voters were purged after wrongfully being targeted, set in motion by illegally altering their permanent voter record, it is not appropriate to blame the voter, whether or not they responded to a letter.

Taking the position that this is a minor matter, or that a purge would be the voter's own fault, claiming that voters wrongfully targeted for purge can always reinstate themselves by responding to a purge letter is like saying "false arrest doesn't matter, because you can always prove you are innocent".

The wrongful act, in case of purge for voters whose histories were altered, is not on the part of the voter.

And there is such a thing as justice.

What happened to the strategically selected voters in Shelby County, whose records were altered to put them at special risk for purge, is a moral wrong.

And it is illegal.

I cannot tell whether more voters may have been affected. Comparing the two databases, I see that over 8,000 voters in District 09 were removed after August 2010 but before the Oct. 2011 database was produced. I do not know the reason for these 8,000 removals.

Hi Bev,
This is totally outrageous!! Is there some way that those responsible for this can be dragged into court and tried for their crimes?

This shows the depths to which a political party (in this case, the Republicans) will go to cheat to win an election. And it shows the absolute importance of intense focus by election integrity folks to be sure to catch these kinds of illegal shenanigans.

An example needs to be made of these criminals so that others will think twice before taking such illegal and disgusting actions.

Great work and reporting on your part, and excellent vigilance by Mr. Harris. Everyone keep up the good work.

1. Per review of 2010 Shelby County demographics
Blacks about 48%, Whites about 48%...So the
high dump of Blacks voters does look odd.

2. Your report indicates "...raw data is getting
altered from time to time..." Is people doing
the alteration or is the data base files being
messed up by faulty software or hardware???

Wow.... I am lost for words.

I rarely respond to request to renew my details and I always double check them (ie go to the website rather then respond to the email/mail). Even so I fail to see a reason why it is needed.

Ok this is a modern database, which user did the deletion? Where is the BACKUP that we can ask for to determine when this deletion was done? More then that Who will HANG for this breech and what will change!

Hi Frank,

I don't think it is possible for faulty software to selectively wipe out only Black, Democratic voter histories in a particular congressman's district, in addition to wiping out the incorrect record of one possible whistleblower employee.

The raw data being altered from time to time is being altered by human beings, however much they might wish they could blame it on software. I call this "the personnel problem" and I am surprised it has not been dealt with decisively by now.

The pattern I show above, and other patterns I have not reported on yet (such as altering records from the electronic pollbooks), are, let's just say, "insufficiently random".

I'm not going to submit this to law enforcement agencies, but I am confident that will happen. The appropriate agency to investigate this is the US DoJ, not the Tennessee Bureau of Investigation (TBI), which is the last law enforcement agency this should go to. The TBI is, if anything, complicit in what's been going on in Shelby County.

Colin, you are indeed astute. Among the documents we recovered from the Shelby County litigation are examples of transaction logs. Using these, I was able to determine exactly which employee was removing racial identifiers, and when.

Furthermore, these records are required to be kept for 22 months because they relate to a federal election.

I am not able to request the documents necessary myself (in Tennessee, you must be a resident to get public records), but am helping to prepare appropriate public records requests for Shelby County citizens.

I plan to get these to interested Shelby County citizens tomorrow so they can follow up. By the way, if you live in Shelby County and would like to conduct an inspection under public records law, it doesn't cost anything and I will be happy to show you the ropes.

Woops, I should clarify: My transaction log documents demonstrate that such records exist, but I obtained them in 2010, and do not have the 2011 transaction logs needed to find out who erased voter histories as described in this story. Thus the need for a Shelby County citizen to follow through pronto. Email me if you would like to help with boots on the ground to inspect documents for the 2011 voter list alterations.

I will also let folks know that I have been in contact with a member of the Shelby County Board of Elections (the BOE functions like a board of directors over the employees that did this) and I have spoken with a staff member for the honorable Rep. Steve Cohen. And I've done a little more networking in other places ... but I am primarily a researcher and writer. If people believe this is important, they will act.

I am a Shelby County Democrat, and having been active in the local political scene for a few years, I recognize a few names on this list. One of them is a current vice chair of the SCDP; another is a campaign manager of one of our congressional candidates; another is a union leader; and you know Dee Harris. I can't believe this was done intentionally, but you never know. If it was, they made an incredibly stupid choice of names - because this is definitely not the group you want to pick on.

Yes, these are politically active and astute voters. I do believe it was done intentially, because it is unlikely to have a "glitch" that just says to itself, "I'm going to affect only Black Democrats in District 9, but not all of them, plus one key election office employee, who may be a whistleblower."

What I think we should look at is whether a larger set of voters had their histories removed, most of whom are not on the list above because they were actually purged. But a hand picked subset of politically astute people, who would go "wait a minute! What do you mean I haven't voted!" were witheld from the purge, leaving only the telltale sign that something happened to their histories. (Sloppy work, wasn't it?)

There were over 13,000 people actually purged between the 2010 and 2011 lists. Most of these had a very active voting history in the 2010 list, but we don't know whether their history was erased in 2011, because they no longer exist on the list at all.

It is true that voters can be purged because they move, die, etc. But if you mix in a few thousand Black Democrats from District 9, erasing their histories to qualify them for purge, who would know?

I found a huge purge in 2009, of about 65,000 people. Of these, they claim that 56,000 had not voted. But the data is missing to corroborate that. In ALL of the All Details files for the time period from Nov. 2006 through Sept 2009, the federal election voting history is left off. They just omitted the columns with that information in it, for all voters, for all voter lists created.

So now I'm very, very curious. Did all of the 56,000 people purged in 2009 actually not vote, or were histories erased for some of them, strategically selected? In taped depositions during the 2010 lawsuit, administrators admitted that a whole lot of people have access to the voter list data. But I did find some interesting files, indicating that Holden was pulling past racial data and asked for one file that was for all past and current Democrats only (but did not ask for same file of Republicans).

Obviously, if you actually purge people in the powerful Ford family, and political consultants like D Harris and Cardell Orrin, they are going to scream bloody murder. So, you know, you don't actually purge those people. The erased histories may be a pointer to a significantly bigger problem. With accounting anomalies, that is often the case.

Bev, this may not be related exactly to this voter list, but do they use Diebold Vote a matic machines in your area? Mr.Diebold,who lives in Ohio, was "W" Bush's campaign manager for Ohio in 2000. I've seen a letter addressed to Bush in which he promised to "Deliver Ohio" to Bush. His machines were used in many locations in Florida in 2000, and they found a machine which had the software disk programmed to count Gore's votes backwards. The Vote a matics are used here, and are optical scanner type machines instead of touch screen or machines which produce "chads", and one good thing about the Vote a matic is that there is a paper ballot backup for every vote. In Florida when the election officials were looking for the ballots from a machine they knew had the disk improperly programmed to count Gore votes backwards, the boxes of paper ballots mysteriously disappeared from a bonded secure warehouse, and not surprisingly, the machine was in a heavily populated and heavily democratic voting area. This one precents votes probably would have given the presidency to Gore instead of "W" Bush.

Well, the points you bring up are (mostly) true, and of great concern. I'm not sure any Mr. Diebold was Bush's Ohio campaign manager; I'd like to see a source on that. The man who promised to "deliver Ohio to Bush" was Wally O'Dell, at that time, the CEO of Diebold Inc.

Absolutely true that the Diebold optical scan machines (which do have a paper ballot, by the way) were used in 2000 in many Florida locations, and that in Volusia County they counted minus 16,000 votes for Gore, which caused the spread necessary for the networks to call the election for Bush. The details of several of these stories are in my book, linked for free on the home page of this site; look at chapter 8 and 13.

The Volusia votes were eventually hand counted, and I have not heard that the ballots disappeared before counting, and would be interested in more information on that. The warehouse incident you are thinking of may be the one in the film Hacking Democracy, where Black Box Voting's Kathleen Wynne and I showed up at the warehouse after the 2004 election, and caught them destroying documents and falsifying records.

A Volusia County citizen, Susan Pynchon, became so concerned by these matters that she founded the Florida Fair Elections Coalition; she was with me personally in Shelby County as we assisted plaintiffs in litigation in securing documents. And speaking of destroying documents and falsifying records, Pynchon has captured crucial video and continues to help towards unraveling the truth in Shelby County.

The Diebold machines are used in Shelby County Tennessee; they use one of the worst models, which has no voter verified paper trail at all, and which is enabled for clandestine wireless communication. That machine is the subject of a Black Box Voting report called the Hursti II report. Enter Hursti II in the search box at this Web site to get that report. Shelby County then made a bad situation worse, by performing customizations on their Diebold system, which introduce custom-programmed software into the midst of the voting machine system.

The Diebold machines generated impossible results in Shelby County in 2010; that is, the votes counted by the machines don't match the number of voters and the voters in the electronic pollbooks don't match the voters listed as voting.

The machines showed a large number of crossover Republican votes in county races for persons who are lifelong Democrats and who chose Democratic ballots in the Aug. 2010 primary. (Now I ask you: How likely is it that Black lifelong Democrats who chose a Democratic ballot in the primary/general would decide to vote against all the Black Democratic candidates in the county race, instead choosing only White Republicans? Not likely. Borders on preposterous. But that's how the Diebold machines counted many of the votes.)

It is sad that something like this happens and immediately there are conspiracies that this was politically and racially motivated. It sounded like from the interview that the report was in error because the database shows them still active. I would however support an outside source reviewing the details of the registry. If we have an outside source look at this discrepancy maybe they can include concerns with voter fraud and registration fraud. Maybe we could make sure that deceased registrations are removed too. Ever since I moved to the Memphis area my friends in other states have joked with me that at least I get to vote twice in Memphis. Lets clean this situation and others up and give Memphis back a reputation that we can be proud of.

They should already have been on it, but this is Obama/Holder who have done nothing about paper trail.

Nevertheless, "Justice" should be notified and picketed, and the media should be informed.

Certainly not. The election commission has confirmed the information in this report. It is actually MORE troubling that elections administrator Holden is now saying that the "real" report shows the histories but the monthly reports omit selected histories. That means the data coming into the reports released to the Democratic and Republican parties, and to the Shelby County Election Commission, is drawn from a different source than whatever Mr. Holden is creating.

This is not about a conspiracy or political or racial motivation. It is simply about facts. The reports, created and provided by Shelby County, omit the history for 488 voters, who are non-random and are basically all Black and all Democrat.

Regarding deceased registrations, the state of Tennessee provides those monthly to each county elections office, and they are removed. When people die, a death certificate is created; this information goes to the state, from whence it makes its way back to the county promptly, and the records are removed.

It is true that people can vote twice in Shelby County (or someone votes twice in their name, which is the more common scenario). That is the subject of the story I am working on right now. However, the multiply-voted names are not mostly from one political party or race.

The important thing about being able to vote more than once in Shelby County is that their system does not catch it. Even though a voting machine records more than one vote, the voter history reports it as a single vote.

That's why it is of particular concern that Shelby County has a history of having more votes than voters.

indicates that elections administrator Richard Holden has created or located a different file, or a file drawn from a different source.

This is even a BIGGER concern, because it indicates that the elections office draws the data provided to commissioners and the public from a different source than the data they now say they actually have. Federal law requires that a single, uniform source be used.

I was pleased to see that some of the reporters who reported this story asked to examine that actual files. I make those available to any reporter, and of course, any reporter can simply ask the election commission for an original. The essence of real journalism is to take a look at the underlying documents themselves.

Holden refers to my "handling of the data."

I cannot tell you how absurd this is. The data is simply a list of names, readable by anyone, with no need to "handle" it or do anything to it other than just read down the list.

The reporter references an email sent to him by Holden. That's nice, but anyone can go to the old database and get the old histories. Holden himself has multiple copies of the older databases on his hard drive. If Holden is running a different report for the public than he really had, then the question becomes, why is there a difference in the data? The list contains 600,000 names and addresses. Holden simply "exports" the data. It is an automated process, and really quite impossible to explain why any system would accidentally not export just the voter history portion for just Black Democrat voters in Dist. 9.

But even if that were explained, what no reporter has asked Holden is this: When you generate a list of voters to send mailers enroute to purge, which of your two lists do you draw this from?

The fact that Holden could only come up with 15 histories indicates he is not just pushing the export button. It takes only about two minutes to generate the full list of 600,000 voters with histories. If Holden has to go look up the rest of them, he is doing some kind of process by hand; I guarantee you that the thousands of voters who receive mailings are not selected one by one, by hand.

Whereas most TV news reporters contacted me and some requested copies of the documents themselves, the reporter for the Commercial Appeal and also the reporter for the Memphis Flyer never even asked for the documents.

As Mark Twain said, "First get the facts, before you distort 'em."

C'mon boys. Get the facts, and those facts are in the All Details document. Then find out exactly how the purge lists are generated and what source of data is used.

The Shelby County Election Commission will check today to assure voting histories they are providing the public are correct.

But the administrator of elections said Monday that an accusation that such history information has been deleted for almost 500 African-American Democrats is inaccurate.

Rich Holden said the office has the records on file, supporting his point by providing an e-mail sent out last week showing the voting histories of about 15 of the people identified as being deleted on blackboxvoting.org, a site run by blogger Bev Harris, who is based in the Seattle area.

"The article from blackboxvoting is incorrect," Holden wrote in the e-mail. "(The attached list of histories) is from the voter registration records on file in our office. We can produce the remaining 400+ if necessary to prove their handling of data is, at best, questionable."

In a May 12 blog entry called "Caught Red-Handed," Harris stated the voting histories of 488 Shelby County voters were deleted, a step, according to her, that could lead to purging those voters from the rolls.

Holden's e-mail last week provided the history for some of the more prominent names on the list, including David and Yvonne Acey, Johnnie Turner and Edmund Ford.

According to Harris, the 488 voters are primarily African-American Democrats in U.S. Rep. Steve Cohen's District 9.

"All these people can vote, and they are still in the database," Holden said by telephone Monday. "That proves they are still in the system and can still vote."

Holden said he plans to review office procedures, but the commission's "records are correct." He said the question may arise from the information provided to the public requesting such data.

 

The public must be able to see and authenticate these four essential steps for an election to be public, democratic, and valid: (1) Who can vote (voter list); (2) Who did vote (3) The original count; (4) Chain of custody.
