In the ES&S acquisition contract for Diebold's Premier Election Systems, the following short list of employees are given special treatment. This list is interesting both for who is on the list and for who is NOT on the list.

While one might expect to see certain individuals who are intimately tied to intellectual property getting golden parachutes and non-compete agreements, this list includes some -- but not all -- of the programmers with intimate knowledge, and also includes some of the PR hacks (Mark Radke), and an Internet disinfo guy Rob Pelletier -- see our special report:

The "special persons" also include a former state elections director who bailed over to Diebold after helping implement a statewide buy (Cathy Rogers, of Georgia).

What's also interesting is that there is no time limit on the special treatment. Usually with "special" employees in an acquisition contract, there is a cap on the time period for noncompetes or golden parachutes.

Never mind where BBV got the contract. We have it, and it says:

In the event that any employee on the "special" list is terminated, for any reason -- EVER, because there is no time limit on this -- then ES&S has to notify Diebold in advance, in writing; and in the event that any employee on the list quits -- EVER, because there is no time limit on this -- then ES&S has to notify Diebold immediately to allow Diebold to put the employee on retainer.

So these guys need to be on a short leash. They know stuff.

Now the above is not unheard of in acquisition contracts, though it is unusual in as far as I can tell, there is no cap on the time limit, and the collection of special people is interesting.

The current method of sorting out the precinct ballot images in the GEMS
ballot audit will not be practical if we deploy AVTS units of any
quantity
in California.
We understand the silliness of printing out an electronic ballot but it is
currently mandated by state law and it does provide everyone involved
(SOS, County and us) with a way to silence the paranoid, X-Files,
anti-technology types.
We will need a quick way, once we have selected the 1% precincts, to hunt
all the AVTS ballot images for that precinct, uploaded to the GEMS
database, and print those images for the manual tally.
