Cynthia McKinney has been gathering evidence, and yesterday began propagating it through a press conference held in Decatur, Georgia. What she's uncovered is important.

In the Georgia primary, the press reported that the machines functioned well, things went smoothly except for a few hiccups. Members of the press need to look a little deeper. U.S. Rep. Cynthia McKinney requested some one-on-one advice from Black Box Voting. We advised her to make public records requests for poll worker notes and troubleshooter reports.

- Bizarre database problems appeared.
- Security flew out the window when dozens of voting machines were used despite broken and mismatched security seals.
- Voting machines hiccupped, choked, flipped and lost votes.

Few public officials have been able to stomach a straight-on look at the civil rights debacle that our new electronic voting systems have become. The first member of the U.S. congress to take a hard look at Diebold touch-screen voting machines was Georgia Democrat Cynthia McKinney, who's been looking into problems with electronic voting since early 2003.

Rep. Cynthia McKinney did public records requests for the sets of documents that citizens all over America are finding useful: POLL MANAGER LOGS, VOTING MACHINE AUDIT LOGS, and TROUBLESHOOTING LOGS. These are the written, on-the-spot logs kept by elections workers that provide evidence of what happened during the Election.

The reports also uncovered another class of problems not reflected here, worthy of an entire investigation on the electronic pollbooks and accompanying databases. Documents in McKinney's district show many flipped ballots. In the primary, registered Democrats were getting Republican ballots, apparently a function of the new Diebold electronic poll books and their interaction with the statewide computerized voter registration database.

Before buying into the "it's a hiccup" theory, let's pause for a moment. If you erect a barricade to prevent an African American from voting, is that a "hiccup?" What if your barricade prevents just a few people from voting? What if your barricade "wouldn't have affected the results?"

EVERY SINGLE DEKALB COUNTY VOTER HAS A RIGHT TO HAVE THEIR VOTE COUNTED ACCURATELY. The candidate has a RIGHT to have their name on every ballot in their district. Let's stop referring to voter disenfranchisement as hiccups and glitches.

In some cases, a husband was sent to one location while his wife, living at the same house, was sent to another. * ExpressPoll is the name of Diebold's Electronic Poll Book, which interacts with the state voter registration database and also selects the ballot that will appear on the touch-screen for the voter.

Serious procedural flaw uncovered regarding machines missing seals and/or with replaced or inconsistent seals

More generalized incident reports like these will follow, but first – one thing McKinney's records request uncovered was a serious procedural flaw in the handling of voting machines with missing security seals.

The Black Box Voting studies with Harri Hursti, the California study, the Open Voting Consortium study, and the Princeton study all show that breaking the seal (or replacing the numbered seal with a different one) can open up devastating fraud, ranging from virus attacks that can spread from machine to machine to complete replacement of the bootloader, contaminating the DRE for the life of the machine. Hacking the zero tape to read "zero votes" at the beginning of the day – even if votes are pre-stuffed into the memory card – can also be achieved. Because using a machine that has had the seal broken or replaced can destroy the credibility of an election, Black Box Voting called DeKalb County to see what the procedure is for machines with broken/replaced seals.

DeKalb County seems to have good people in their elections division, but it is clear that Georgia Secretary of State Cathy Cox has either minimized the severity of the problem if voting machine seals are not intact, or has failed to educate Georgia elections workers of the specific vulnerabilities altogether. Because they don't understand the nature of the exploits that can be achieved once you open the case or get at the memory card, the mitigation procedure is meaningless. Dozens of machines were demonstrably wide open for tampering, with broken or replaced or incorrect seals.

If a seal number does not match the paperwork for the voting machine: Glenda, from DeKalb County if it doesn't match "they call in to us and we have someone here to take care of it."

Asked what would be done to take care of it, Glenda didn't know and transferred the call to Dwight Brower, who said:

"This is what we do we actually go in and bring the machine up, check and run the zero tape to make sure there are no votes on the machine and managers make a note of it. The seal will break oftentimes, during transit. We don't send anyone out there; normally what the manager will do is they will call us and we ask them to go ahead and bring it up and take a look at it, see that there's no obvious evidence that anyone tampered with it. "

Black Box Voting: So you handle this over the phone, have them look for evidence of physical tampering, and run a zero tape and then make a note of it and use it.

Brower: Correct.

One thing we look for when contacting public officials is their willingness to answer questions. We found DeKalb County to be responsive. If your public officials are obstructive, that behavior makes it look like they have something to hide, but in DeKalb County, the helpfulness of the staff indicates to us that this is a training problem. It appears that the Georgia state officials have failed to let the local officials know the specific risks associated with a broken seal.

Election worker memo: Problems with ExpressPoll machine:
1. With a hyphenated name, sometimes the name appears and sometimes on no records
2. Many came to the wrong precinct (at least 50 by 2:30 pm) They did not receive a card to change the location to vote.
3. A person requested an absentee ballot but did not receive one by mail before the election
4. A person did not request an absentee ballot but received one in the mail
5. One spouse was to vote in our precinct and the other spouse to vote at the Lutheran precinct.
6. A person was on the state listing by first initial, not first name
7. A name came up on machine #1 but not machine #2
8. Some cases must show date of birth on state roster and others have to leave off date of birth.

And this is just the evidence uncovered in ONE COUNTY. Next time you read in the newspaper that "the election went smoothly, except for minor glitches" dig a little deeper. Get the records. Find out for yourself, and when you spot a problem, propagate the information.

The actions taken by U.S. Rep. Cynthia McKinney expose real issues that should be taken seriously. This is not a matter of "sour grapes" or "sore loser." This is a matter of being willing to look at problems objectively, and exposing them so they can be remedied.

Rep. McKinney didn't have to take this action. She has done so in order to protect the citizens in Georgia and, as the issues uncovered by her public records request are corroborated by evidence collected from citizens elsewhere, to improve the quality of elections in the United States.

This is simply appalling. It is horrifying to think that these massive malfunctions were considered acceptable and were not questioned or otherwise revealed at the time.

Good job Bev!!! This is a stunning amount of evidence. to see you and Cynthia Cooperating and together in that press conference, was like seeing a dream come true. The 2 most vocal advocates of election integrity, working together to announce to the world the stunning way they lie us into thinking we have a democracy. I love your line:

This is no different-and,believe it or not, actually less of the same thing- than in San Diego, CA that used the AVOS and AVTSxPM machines in the June 2006 election. Of course San Diego County is much larger than DeKalb, so the larger quantity is to be expected; In San Diego, if the seals didn't match, the precinct called in and was told that if the 'sequence numbers' (a 'sequence number' references the 3 memory cards used, one in the AVOS and one each in the AVTSxPM machines) 'matched' 'don't worry about it'.
Of course ,that would lead one to wonder how the precinct workers could tell the 'sequence number' without removing the memory cards and that,well...
 

The public must be able to see and authenticate these four essential steps for an election to be public, democratic, and valid: (1) Who can vote (voter list); (2) Who did vote (3) The original count; (4) Chain of custody.
